Use of and access to the parlezmoidavenir.ch website and participation in the TVM3 program Parlez-moi d'avenir are exclusively reserved for natural persons who have reached the age of majority according to the law in force in their country of residence, but in all cases they must be over 18 years of age and have full faculties and capacity for discernment. Our site is for adults only and does not offer services for minors. If someone we know to be under 18 sends us personal information, we will delete or destroy that information as quickly as possible.

The non-consultant staff of Parlezmoidavenir.ch or the program Parlezmoi d'avenir on TVM3 are not authorized to give advice or consultations of divinatory arts. parlezmoidavenir.ch and/or the program Parlez-moi d'avenir on TVM3 ensures only the technical relation between the Internet users or the televiewers (user) and the consultants, the advice and the comments lavished by the consultants are not dictated by parlezmoidavenir.ch or the program Parlez-moi d'avenir on TVM3 or TVM3 SA, they are the sole responsibility of the consultants themselves. parlezmoidavenir.ch or the program Parlez-moi d'avenir on TVM3 or TVM3 SA cannot be held responsible for the services provided by the consultants, in particular: the quality of the services offered by the consultants, their comments their evaluation and any professional qualifications cannot in any way be under the responsibility of parlezmoidavenir.ch or the program Parlez-moi d'avenir on TVM3 or TVM3 SA.

parlezmoidavenir.ch or the program Parlez-moi d'avenir on TVM3 or TVM3 SA can in no way be held responsible if an Internet user or viewer (user) suffers any harm as a result of a consultation provided by a consultant

parlezmoidavenir.ch or the TVM3 program Parlez-moi d'avenir are services offered by TVM3 SA, a company registered in Switzerland.

2. Member area and member registration.

Credit card payments and reviews are reserved exclusively for members registered on the parlezmoidavenir.ch website

Registration as a member of the parlezmoidavenir.ch site is reserved exclusively for natural persons who have reached the age of majority under the laws of their country of residence, but in all cases must be over 18 years of age and have full faculties and capacity for discernment. The Internet user and/or viewer (user) must ensure that the legislation in their country of residence does not prohibit fortune-telling activities and, in general, the professional practice of divinatory arts.

Internet users registered as members of the parlezmoidavenir.ch site assume full responsibility for the data entered in their account. The Internet user using our services undertakes to inform us as soon as possible of any fraudulent operations that he/she may have noticed using his/her password or account, or of any other action that may lead to a security breach. 3. Closing an account

A member's account can be terminated at any time by parlezmoidavenir.ch and/or TVM3. parlezmoidavenir.ch and/or TVM3 do not have to justify themselves and no compensation or any other claim can be made against parlezmoidavenir.ch and/or TVM3.

It is strictly forbidden for any user of our services to have two accounts under the same identity. In the event of non-compliance with this clause, parlezmoidavenir.ch and/or TVM3 reserves the right to close/suspend or even terminate the account(s) of the Internet user in question, and to immediately deny him/her access to the site parlezmoidavenir.ch for an indefinite period of time.

6. Consultation with credit card payment

If you use the credit card payment service, you accept the consultation rates indicated on the site parlezmoidavenir.ch. Rates are subject to change at any time without notice from parlezmoidavenir.ch and/or TVM3. By placing a call, the Internet user or viewer using our services accepts the rate indicated.

parlezmoidavenir.ch and/or TVM3 provide a Swiss telephone line (fixed-line networks) for consultations paid for by credit card. This Swiss line is not surcharged. The price of a local call is charged to the caller. The cost of the call may vary according to the region or country in which the caller is located and the telephone operator.

SMS consultation

The current price of the SMS consultation is clearly indicated on the parlezmoidavenir.ch website and before the consultation itself. Once the consultation has begun, the Internet user using our services can no longer waive his or her right to it, nor can he or she claim any reimbursement for the consultation.

Chat consultation

The current rates for chat consultations are clearly indicated on the parlezmoidavenir.ch website and before the consultation itself. Once the consultation has begun, the Internet user using our services can no longer waive this right and can no longer claim any reimbursement for the consultation.

Written consultation

The current rates for written consultations are clearly indicated on the parlezmoidavenir.ch website and prior to the consultation itself. From the moment the consultation has begun, the user of our services can no longer renounce it and can no longer claim any reimbursement for the consultation. If for any reason the consultant does not respond to the user's written request, the consultation will be cancelled and reimbursed in the form of connection minutes to the user who initiated the conversation.

7. Consultations

Internet users and/or television viewers using our services, whether on the parlezmoidavenir.ch website or on television during the Parlez-moi d'avenir program, undertake to contact the consultants connected only for the service that the consultants are likely to offer.

Any request or attempt to persuade that is illicit or contrary to the code of ethics may not be requested by the Internet user and/or viewer using the services of parlezmoidavenir.ch and/or the television program Parlez-moi d'avenir.

It is also formally forbidden to incite the consultants present on the service offered by parlezmoidavenir.ch and/or the television program Parlez-moi d'avenir to provide services outside the services offered by parlezmoidavenir.ch and/or the television program Parlez-moi d'avenir.

parlezmoidavenir.ch does not authorize Internet users to record exchanges/consultations with consultants present on the service offered by parlezmoidavenir.ch.

8. Use of premium rate telephone numbers

Whether you're a member or not, you can use the premium rate number to contact the available consultants at any time. The price indicated on the site and in the TV program corresponds to a call from a landline. This rate may vary depending on your operator, and could increase significantly if you call from a cell phone. We advise you to contact your mobile operator to check rates.

10. Credit card payments

The user acknowledges that by using paid services, he/she is obliged to pay for the services provided. Where applicable, it is the user's responsibility to update his/her bank details in good time and to inform the site of any payment incident. In the event of payment by credit card, the user guarantees parlezmoidavenir.ch and/or TVM3 SA that he/she has the necessary authorizations to use this method of payment

The credit card payment order made through the secure service of parlezmoidavenir.ch and/or TVM3 SA with our partners is irrevocable.

The user therefore has no right to object to this payment or to a refund of the consultation, if he or she is not satisfied with the consultants' service.

11. Collection and litigation

It is clearly specified to the Customer that in the event of an incident and/or delay in payment, all costs necessary to recover the sums due will be charged to the Customer in full, and in particular the costs of registered mail, bailiff's fees for service and possible seizure, court costs and lawyer's fees. The sums due will bear interest at the legal rate in force as from the first reminder for payment incident.

12. User rights

The Internet user and/or viewer using the service declares that he/she is in full possession of his/her abilities. In particular: he/she is not in debt and is not undergoing medical treatment for depression or a similar illness. As indicated in the preamble, the service is reserved solely for persons who have reached the legal age of majority in their country of residence, i.e. 18 years of age. In all cases, the service is authorized for people who have reached the age of 18.

The Internet user and/or viewer using the service declares that he/she is solely responsible for what he/she writes on the parlezmoidavenir.ch site or for what he/she says during consultations, for which he/she may assume full responsibility. They are also solely responsible for their choices and actions.

It is strictly forbidden to trade or resell the services offered on the site parlezmoidavenir.ch.

The user undertakes to use the Site's services and all the information to which he/she may have access only for personal reasons and in a manner consistent with public policy, accepted standards of behaviour and the rights of third parties. The user acknowledges that he/she has checked that the computer configuration he/she is using is virus-free and in perfect working order. The user undertakes not to disrupt the use that other users may make of the Site and not to access parts of the Site to which access is reserved. The user undertakes not to commit any act that could jeopardize the computer security of parlezmoidavenir.ch or other users. 13. Risk against addictions

The Site/Application invites the Customer to be particularly vigilant about his consultations, their frequency and the sums spent. In this context, the user may also, at any time, request parlezmoidavenir.ch and/or TVM3 to block his/her account for a fixed period, set by the user, or definitively. This request must be made in writing to the address of TVM3 or by e-mail to the following address infos@tvm3.tv. however, parlezmoidavenir.ch and/or TVM3 cannot be held responsible for any fraud committed by a Customer who continues to use the Service even after its intention to block.

14. Dispute with a consultant

Parlezmoidavenir.ch and/or TVM3 are in no way responsible for the consultations. Any disputes are to be settled with the consultants themselves.

In the event of a proven and documented dispute by the user or consultant, parlezmoidavenir.ch and/or TVM3 may intervene as mediator and insofar as all parties agree to communicate personal information to one or other of the protagonists. Any legal obligation is of course reserved. In all cases, however, only Parlezmoidavenir.ch and/or TVM3 can decide, without having to justify themselves, whether or not to pass on personal data or information concerning an Internet user or consultant.

Except in the case of a legal obligation or court order, parlezmoidavenir.ch and/or TVM3 cannot be compelled to provide information. Any information transmitted by parlezmoidavenir.ch and/or TVM3 is the sole responsibility of its authors. parlezmoidavenir.ch and/or TVM3 cannot be held responsible if it is false or inaccurate.

15. Terms and conditions of publication

The user must follow the following rules to publish any User Content and in particular any advice on consultants concerning their maintenance.

To post a review, the user must have an account on parlezmoidavenir.ch that identifies him or her or have been invited to post a review by an email sent by parlezmoidavenir.ch, while having honored the appointment or interview with the consultant.

In order to avoid any conflict of interest and for obvious reasons of objectivity, if the user works in a profession related to divinatory arts, he/she is not authorized to publish opinions about parlezmoidavenir.ch.

The notice must relate exclusively to the consultant. Any notice mentioning another consultant may be refused by parlezmoidavenir.ch.

The member must have completed a consultation lasting at least 5 minutes.

Members must enter their real first name, which will not be visible to Internet users.

Comments and notes are intended to mark or congratulate consultants who have carried out an interview with a member.

The notice must be published within 15 days of the consultation.

Only one comment and one note are allowed per consultation.

parlezmoidavenir.ch and/or TVM3 cannot be held responsible for comments made by members using the reviews and ratings service.

By submitting comments on consultants, users grant parlezmoidavenir.ch and/or TVM3 the right to reproduce and adapt the commentary free of charge, without limitations as to place, time or type of medium. Users are reminded that once a comment has been submitted, it cannot be modified or deleted.

Reasons for rejecting User Content

The User is informed that his User Content may be rejected for the following reasons:

if the "Conditions of publication of notices" set out above are not respected by the User ;

if parlezmoidavenir.ch considers that its civil or criminal liability may be incurred ;

if the User Content or elements relating to the identity of the author contain insults or coarse language ;

if the textual User Content contains random characters or word sequences without any meaning ;

if the User Content is unrelated to the consultant who conducted the interview ;

if the User Content is or is suspected of being infringing ;

if the advice raises or if parlezmoidavenir.ch considers that the advice contains elements of conflict of interest or fraud ;

if the textual User Content is so poorly written as to be unintelligible ;

if a User makes an inappropriate comment about another User Content or its author ;

if the User Content contains personal information or elements likely to lead to identity theft, such as the first or last name of individuals who are not public figures, a telephone number, a precise physical address or an e-mail address

if the User Content mentions websites, hyperlinks, URLs, email addresses or telephone numbers; or

if the User Content is clearly spam.

In case of identification of a User having deposited a fraudulent opinion or that parlezmoidavenir.ch considers to be fraudulent, and after having applied the procedures related to the rejection or the deletion of opinions, parlezmoidavenir.ch will be able to deactivate the account of the User concerned and will delete all the opinions related to this User.

16. Personal message to the consultant

Registered members of parlezmoidavenir.ch have the opportunity to send direct messages to the consultant, for example: to suggest a date for an appointment, to prepare a consultation. The first name, nickname and any photo will be sent to the consultant.

Private messages are moderated by the parlezmoidavenir.ch team before being forwarded to the consultant.

In order to preserve the anonymity of members, the parlezmoidavenir.ch team will remove any private information from personal messages: private address, Internet addresses, telephone number, real name, etc.

17. Use of the website parlezmoidavenir.ch

Given the specific characteristics of the Internet, parlezmoidavenir.ch offers no guarantee of access to the site parlezmoidavenir.ch and television program Parlez-moi d'avenir or continuity of service, being bound in this respect only by an obligation of means.

However, as parlezmoidavenir.ch cannot materially verify the accuracy of the information collected and/or given by the consultants, the User accepts that parlezmoidavenir.ch and/or TVM3 cannot be held responsible if the User is unable to benefit from the services. In fact, the settings of the software used to connect with the consultants depend in part on the information provided in real time and/or recorded by the consultant, and may not correspond to reality. Thus, for example and in a non-exhaustive manner, the user acknowledges and accepts that the responsibility of parlezmoidavenir.ch and/or TVM3 cannot be invoked in the event of reservation cancellation, telephone network failure, for any reason whatsoever, or in the event of service refusal, for any reason whatsoever.

In the same way, the user accepts that the responsibility of parlezmoidavenir.ch and/or TVM3 cannot be engaged if the user does not manage to benefit from the promotions or special offers proposed by parlezmoidavenir.ch and/or TVM3. These terms and conditions may be modified at any time and without prior notice by parlezmoidavenir.ch and/or TVM3. By continuing to access and/or use the services of parlezmoidavenir.ch and/or TVM3 after any changes to the terms and conditions, the user confirms acceptance of the new version of the terms and conditions.

22. Applicable law and place of jurisdiction

This site was created in Switzerland. Its use is subject to Swiss law.

The official language of the site is French and the French version prevails over any foreign version. The interpretation and execution of the present General Terms and Conditions, as well as all acts which may precede, follow or result from them, shall be subject to Swiss substantive law.

The place of jurisdiction for all disputes arising in connection with these terms and conditions is Lausanne (Switzerland).
